Who we are

Counterly builds and runs websites, kiosks, online ordering and loyalty for local restaurants, bakeries and shops, from California. For anything in this notice, email [email protected].

What we collect, and why

The contact form

Your name, email, business type and, if you add them, your website and phone number. We use them to reply to you about Counterly and for nothing else. The form is emailed to us; it is not written to a database.

Opening a counter

Your shop’s name and your email. We use the email to send you the link to your counter, to tell you about things that need you (an order waiting, a screen gone dark, a publish that did not arrive) and to reply when you write to us. We keep both for as long as the counter exists.

Your shop’s page

What you put on your counter as your shop’s menu, hours, address, contact details and About is published on your shop’s own page at counterlyapp.com/m/, because showing it to customers is what it is for. The email you opened the counter with is never shown there.

Signing in with Google

If your shop lets named people sign in with Google, we keep the addresses the owner adds, and Google tells us which address somebody signed in with. We keep nothing else from Google.

Paid plans

Stripe takes your card on its own page; we never see or store card details. We keep the Stripe customer and subscription ids and whether the plan is active, so the counter can show your plan and let you cancel it.

The free website score

The web address you enter. We fetch that public page once and check it. If you ask for the report by email, we store your email, the address and the result, so we can send the report and follow up once, and the page’s text goes to Anthropic to write the paragraph at the top of the report. Without an email, we keep no record of you or the address, only a count of how many scores were run.

Customers of the shops on Counterly

If you order from a shop that runs on Counterly, ask it about an item, or give it your number for its punch card, we hold that for the shop: your name and the order, and an email address or phone number where you gave one. It is the shop’s, not ours — we do not sell it, advertise with it, or contact you on our own account, and nothing here is ever texted to you. The shop’s own website has a privacy notice saying how it uses it.

Server logs

Our hosting providers keep standard request logs, including IP addresses, for a short time. We use them for security and for the limits that stop one address flooding a form.

Your browser

No cookies and no tracking scripts. A few things are kept in your browser’s own storage so the counter works; the cookie page lists every one.

Who processes it

A small number of providers run parts of Counterly for us, each under its own terms: Cloudflare (hosting and the contact form), Railway (our server), Supabase (the database and photo storage), Resend (email), Sentry (reports of errors in our code, which carry what broke and where and never what you sent), Stripe (paid plans, and card payments for shops that take them through Stripe), Square (for shops that connect their Square register), Google (Sign in with Google) and Anthropic (reading a menu photo an owner uploads, and the paragraph on an emailed website score). We do not sell personal information, we do not share it for advertising, and we do not use it to train anything.

How long we keep it

A counter and everything on it, until you delete it. Contact form emails for as long as the conversation is live. Score leads for up to twelve months. Deleting a counter removes it from our database at once; copies in our database provider’s backups roll off on their own schedule and are never restored to bring a deleted counter back.

Your rights

• Download everything. Settings on your counter, Download everything: every row your counter holds, as one file.
• Delete everything. Settings on your counter, Delete this counter. It is gone at once, photos included.
• Anything else — what we hold about you, correcting it, deleting it when you are not an owner — email us and we do it within 45 days, usually the same week.

We will never treat you differently for asking. If you are in California, these are also your rights under the CCPA; we have no sale or sharing of personal information for you to opt out of.

Children

Counterly is for business owners and is not directed at anyone under 16.

Changes

If what we collect changes, this page changes with it and the date at the top moves.
